San Luis Obispo county clerk-recorder Elaina Cano has released a statement on a recent demand from the department of justice.
Her release says the DOJ hand-delivered a letter to the elections office, demanding “confidential voter registration information” and action on Cano’s part “that would affect certain vote-by-mail ballots based on allegations of voter ineligibility.” Elaina Cano says: “my office follows the law, protects our voters’ confidential information, and counts every legally cast ballot.”
Cano then says her office follows state and federal laws for determining voter eligibility, and challenging this eligibility. “The demands presented by the DOJ’s letter are not a substitute for those legally prescribed procedures. A list of individuals alleged to be ineligible to vote does not, on its own, authorize our office to set aside their ballots or disregard established election law.” She says her office is reviewing a formal response.
